Article 1 – Definitions
For the purposes of these terms and conditions, the following definitions apply:
Cooling-off period: the period during which the consumer may exercise the right of withdrawal.
Consumer: a natural person acting outside the scope of a professional or commercial activity who enters into a distance contract with the seller.
Day: calendar day.
Continuous performance distance contract: a distance contract relating to a series of products and/or services, the delivery and/or performance of which is spread over time.
Durable medium: any tool that enables the storage of personal information in a way that allows future consultation and unchanged reproduction.
Right of withdrawal: the consumer’s right to withdraw from the distance contract within the cooling-off period.
Seller (Entrepreneur): a natural or legal person who offers products and/or services to consumers at a distance.
Distance contract: a contract concluded within an organized system for distance selling of products and/or services, up to and including the moment the contract is concluded through one or more means of distance communication.
Distance communication technique: a method used to conclude a contract without the simultaneous physical presence of the parties.

Article 3 – Scope of Application
These terms apply to all offers, distance contracts, and orders between the seller and the consumer.
The text of these terms will be provided to the consumer before the contract is concluded. If this is not reasonably possible, the consumer will be informed that the terms may be inspected at the seller’s premises or provided free of charge upon request.
For electronic contracts, the terms will be made available so they can be stored on a durable medium. Otherwise, instructions will be provided on how to obtain them.
If additional product- or service-specific conditions apply, they will also apply accordingly. In the event of a conflict, the provision most favorable to the consumer prevails.
If any provision is invalid, the remaining provisions remain in force. The invalid clause will be replaced with one that reflects its original intent.
Matters not covered will be interpreted in the spirit of these terms, and ambiguities will be interpreted in favor of the consumer.
Article 4 – The Offer
If an offer has a limited validity period or specific conditions, this will be clearly stated.
The offer is non-binding. The seller may modify or withdraw it.
The offer includes accurate and sufficiently detailed descriptions of the goods/services to allow proper evaluation. Images reflect the products as accurately as possible but are not binding in case of obvious error. Specifications and images are indicative and do not justify refunds or contract termination. Displayed colors may differ from actual colors.
Each offer clearly states the consumer’s rights and obligations, including:

price (excluding customs duties and import VAT, which are the customer’s responsibility);

shipping costs;
-
method of contract conclusion;
-
right of withdrawal (if applicable);
-
payment, delivery, and performance methods;
-
validity of the offer or price guarantee;
-
cost of distance communication (if higher than standard rates);
-
storage of the contract and access method;
-
possibility to review and correct entered data;
-
available languages;
-
applicable codes of conduct;
-
minimum contract duration for continuous contracts;
-
optional: sizes, colors, materials.
Article 5 – Conclusion of the Contract
The contract is concluded when the consumer accepts the offer and meets the stated conditions.
For electronic contracts, the seller confirms receipt electronically without delay. Until confirmation is received, the consumer may cancel.
The seller ensures appropriate technical and organizational security measures. Electronic payments are secured.
The seller may verify the consumer’s creditworthiness within legal limits and may refuse or adjust orders for justified reasons.
At or after contract conclusion, the seller provides (in writing or storable form):

address for complaints;

withdrawal procedure and conditions (or exclusion);
-
warranty and after-sales information;
-
Article 4 information if not already provided;
-
termination terms for long-term contracts.
For continuous contracts, this applies only to the first delivery.
Contracts are subject to product availability.
Article 6 – Right of Withdrawal
The consumer may withdraw within 14 days without giving reasons. The period starts the day after delivery of the goods or final item.
During this period, the consumer must handle the product carefully and only inspect it as necessary. If withdrawing, the consumer returns the product with accessories in original packaging according to instructions.
The consumer must notify withdrawal in writing (including email) within 14 days and return the goods within an additional 14 days, retaining proof of shipment.
If not exercised properly, the contract remains valid.
Article 7 – Costs of Withdrawal
Return shipping costs are borne by the consumer.
The seller refunds payments within 14 days of withdrawal, provided the goods are returned or proof of shipment is provided.
Article 8 – Exclusion of Withdrawal
Withdrawal may be excluded for:

custom-made goods;
-
personal goods;
-
perishable goods;
-
goods inseparably mixed;
-
price-fluctuating goods;
-
newspapers or magazines;
-
unsealed audio/video/software;
-
unsealed hygiene products.
For services:
-
accommodation, transport, or event bookings on specific dates;
-
services started with consumer consent before withdrawal period ends;
-
betting and lotteries.
Article 9 – Prices
Prices remain fixed during the offer period unless VAT changes.
Market-linked price goods are indicated as such.
Price increases within 3 months allowed only if legally required; after 3 months only if agreed and consumer may terminate first.
For deliveries outside the EU, import duties/taxes are customer’s responsibility. Seller does not charge VAT.
Printing errors do not create liability.
Article 10 – Conformity and Warranty
Goods/services conform to the contract, stated characteristics, normal use, and law.
Manufacturer warranty does not limit legal rights.
Defects must be reported within 14 days and returned in original packaging.
Warranty duration equals manufacturer’s warranty.
No liability for misuse or modification.
Article 11 – Delivery and Performance
Orders are processed carefully. Delivery occurs at the consumer’s address.
Delivery within 30 days unless agreed otherwise. Delays allow cancellation without cost and possible compensation.
Refunds issued within 14 days after cancellation.
If unavailable, substitute product may be offered; consumer informed clearly. Return costs for substitute borne by seller.
Risk transfers upon delivery unless agreed otherwise.
Article 12 – Continuous Contracts: Duration, Termination, Renewal
Indefinite contracts: consumer may terminate anytime with max one month’s notice.
Fixed-term contracts: terminate at end date.
Automatic renewal prohibited except limited magazine subscriptions (max 3 months with 1-month notice).
Periodic contracts renew only if cancelable anytime with max one month’s notice.
Trial periods do not renew automatically.
Contracts over one year: consumer may terminate after one year with max one month’s notice.
Article 13 – Payment
Unless otherwise agreed, payment within 7 days of withdrawal period start; for services, from confirmation.
Payment errors must be reported immediately.
Late payment may incur reasonable charges.
Article 14 – Complaints
Complaints must be submitted clearly within 7 days of discovery.
Seller responds within 14 days or acknowledges and gives timeline.
Unresolved complaints may proceed to dispute resolution.
Complaint does not suspend obligations unless agreed.
Valid complaints may result in free repair or replacement.
Article 15 – Applicable Law
All contracts are governed exclusively by Dutch law, even if the consumer resides abroad.
Article 16 – CESOP
From 2024, under VAT and payment regulations, providers may register transaction data in the European CESOP system for tax purposes.
